Because we understand most private lenders are not familiar with the foreclosure process, we have included a brief synopsis below of how the process starts.

The initial step in the foreclosure process is the Right to Cure letter also known as a Letter of Intent to Foreclose. This letter explains to the borrowers the amount they are delinquent and gives them the timeframe in which they must bring the loan current to avoid foreclosure.   If the loan is not paid in the timeframe given in the Right to Cure letter we are then able to proceed with foreclosure.

Should you decide to initiate foreclosure we will send you a package which includes a Declaration of Default, Substitution of Trustee and Default Worksheet. These documents are very important and are required before we can initiate the first legal action. We will request such items as copies of the Note, Deed of Trust and Title Policy. Also needed will be the signature of all beneficiaries listed on the deed of trust or assignment of deed of trust,  a breakdown of all amounts due on the loan, property address, original borrower name, current borrower (if different than original) , social security numbers, current address, etc….
